What Is an Uncontested Divorce in Ontario?
An uncontested divorce, also called a simple divorce, means you are asking the court for one thing only: to legally end your marriage. No property battles. No custody fights. Just a clean, straightforward process.
To qualify, you need to meet a few basic requirements:
- At least one spouse must have lived in Ontario for 12 months before filing
- You must have been separated for at least 12 months
- Your spouse cannot file a contested response
- Any child support obligations must be properly addressed
Sole Application vs. Joint Divorce — What Is the Difference?
A sole application means one spouse files. Your spouse does not need to sign anything they simply do not respond. A joint divorce is filed by both spouses together. It is slightly faster since it shows both parties are on the same page. We help you choose the right approach.

Do You Need a Separation Agreement First?
An uncontested divorce only ends the marriage. It does not resolve property, support, or parenting issues.
If those things are still unsettled, you need a separation agreement. We can prepare both at the same time saving you time and keeping everything on track.

Your Most Common Questions
What if I cannot find my spouse?
We still handle it. Ontario courts allow alternative service methods when a spouse cannot be located. We manage the entire process.
Can I get an uncontested divorce if we have children?
Yes, but child support must be properly addressed. We help you satisfy this requirement so there are no delays with your filing.
What if my spouse lives outside Canada?
Your spouse gets 60 days to respond instead of 30. The process is otherwise the same. We coordinate international service as part of our service.
Do I need my original marriage certificate?
Yes. You need your original certificate or an official copy. If you were married in Ontario, you can order one from the Office of the Registrar General. We walk you through this at your consultation.
